Terms of Service

By using SPEDMinutes you agree to these Terms. SPEDMinutes is operated by The In App LLC (“we,” “us”).

SPEDMinutes is a calculation, checklist, caseload organization, and progress-monitoring quiz creator for special education case managers. It is a productivity utility, not a system of record. SEIS or your district’s official IEP system remains the system of record for all student data.

Our handling of data that reaches our servers — including IEP goal text processing, bell schedule processing, and analytics on our marketing pages — is described in our Privacy Policy. Device-local nicknames are not transmitted to us and are described in Section 04.

SPEDMinutes does not provide legal, educational, or compliance advice. Calculations, checklists, quiz items, and recommendations within the application are tools to assist the user’s professional judgment. The user is solely responsible for the accuracy and legal sufficiency of all IEP-related work.

You will not enter student personally identifiable information into any field that is saved to our servers. Those fields include schedule labels, class names, service descriptions, and IEP goal text. You will not attempt to bypass the name-detection guardrail on IEP goal text or otherwise circumvent the application’s PII protections.

Device-local nicknames are the exception, and they are permitted. A nickname you attach to a student on the Caseload or IEP Workflow Checklist tab is saved in the browser profile on the device where you typed it. It is not transmitted to us and is not stored on our servers, and it remains your own data: you choose whether to use the feature, and you can export or clear those nicknames at any time from the Caseload tab. Because they are held on your device rather than by us, you are responsible for the device itself — including who else can use it and what happens to the nicknames if you clear your browser data.

You will comply with all applicable district, state, and federal laws governing student records, including FERPA, IDEA, and California Education Code, in your use of SPEDMinutes. You will not share your account. You may edit or delete any text you have entered at any time.

SPEDMinutes is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that calculations are error-free, that AI-generated quiz items are pedagogically appropriate for every student, or that the service will be uninterrupted.

To the maximum extent permitted by law, The In App LLC, its members, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, professional reputation, or employment, arising from or related to your use of SPEDMinutes — including but not limited to errors in service-minute calculations, missed deadlines, IEP non-compliance findings, due process complaints, or adverse employment actions. Our total aggregate liability for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless The In App LLC from any claim arising out of your use of SPEDMinutes, your violation of these Terms, or your violation of any law or third-party right — including any claim arising from student personally identifiable information you entered into a field saved to our servers in violation of Section 04. This does not extend to device-local nicknames, which Section 04 permits.

Subscriptions are billed through Stripe at the price displayed at signup. You may cancel at any time from Settings. Refunds are handled per the policy displayed at the point of sale.

You may terminate your account at any time from Settings. We may suspend or terminate your access for violation of these Terms.

These Terms are governed by the laws of the State of California. Any dispute shall be resolved in the state or federal courts located in Contra Costa County, California.
